SRI PRESS RELEASE UPDATE

On February 14th, 2002, Survivors' Rights International
(SRI) and the Women's Alliance for Peace and Human
Rights in Afghanistan (WAPHA) released a special report
titled, "Severe Persecution and Violence Under the
Taliban's Veil: War Against Women as Crimes against
Humanity." In 1996, when the Taliban took power,
women's lives, as they knew them, changed drastically:
suddenly they lost all their constitutional rights as
human beings; instead, the Taliban enforced gender
apartheid policies. Laws were created and enforced that
resulted in severe persecution and egregious acts of
violence against women. These acts constitute crimes
against humanity under customary international law and
international humanitarian law.
Under international law, crimes against humanity are
recognized as crimes so severe that they threaten the
peace and security of all nations and all humankind.
Crimes against humanity are well established as crimes
under international criminal law carrying penalties for
derogation for which there is no statutory limitation
for the right of prosecution, unlike war crimes.
The Taliban's institutionalized laws and state ideology
to persecute, to physically and mentally harm women are
crimes against humanity, that have been documented in
numerous report and media accounts. This persecution
was widespread and systematic persecution on an
identifiable group with immutable characteristics –
women.
During restructuring it is imperative that women, as
active participants, have de jure and de facto complete
rights and protection under the law. For this to occur
the perpetrators of the heinous crimes committed must be
tried and justice must be brought to the victims. In
addition, great measures must be taken to educate the
Afghan society on the important role women play in a
humane society.
Allegations of crimes committed must be investigated
immediately and with utmost diligence. Specifically,
trafficking of persons, sexual slavery, forced marriage
(as spoils of war), and forced prostitution should be
investigated. Finally, the perpetrators of these crimes
should be barred from holding any political or
governmental positions in the future.

Seminar Series at Johns Hopkins University, School of
Advanced International Studies on February 8th, 2002, by
